Wiki Hospital Visit then Office Visit

Surgeon A saw a patient in the hospital on 4/30/14 for an initial visit (consult) the patient came in to the office to see Surgeon A on 5/5/14.
Can I bill a new patient visit for the office visit since the POS is different?

If so where can I find that documentation?

New patient visit would not be appropriate.

CPT definition of a “New Patient”: As defined in Evaluation an Management (E/M) Service
Guidelines - - “Solely for the purposes of distinguishing between new and established patients, professional services are those face to face services rendered by a physician and reported by a specific CPT code(s). A new patient is one who has not received any professional services from the physician or another physician of the same specialty who belongs to the same group practice, within the past three years.”

At one time a coder friend had told me that since the POS was different the surgeon could bill a NP for each setting but following the CPT verbiage/ruling makes more sense
