Surgeon A saw a patient as a consult/initial pt in the hospital on 4/30/14 the patient then came in to see Surgeon A in the office on 5/5/14. Can I bill a new/initial pt for both visits since the POS is different?

If so where can I find that documentation?

No, the 5/5/14 visit in the office is established. POS is irrelevant when determining new vs establ patient codes. You can find the documentation in the E/M Guidelines in the CPT book.
