If a molecular test is ran and after 2 attempts it fails, we result it as "invalid" can we still bill for the service?

Did you bill for the first specimen?

I have had scenarios where the first one wasn't able to be resulted; patient returned to office for a repeat.
We billed the first one normally with dx code provided for why it was being done.
The patient later returns and a repeat is performed; we apply modifier 76 (if I recall correctly we would not be paid).

I haven't ever had two specimens unable to be resulted. But if I ever did the second and third subsequent testing would both be billed with modifier 76.

This has been our policy for an extended amount of time; we also would treat our pap smear charges with this same scenario.
