How would you code this situation?


A patient is placed in observation status the previous night - 9PM. During that time a consult is put in for a Neurology visit. The Neurologist see's the patient at 11:00 AM the next day. At 12:00 PM that same day the patient's status has been changed to in-patient.
How would you code the neurologist visit? Out-patient or in-patient?

Assuming that the insurance no longer recognized consult codes I would apply the following advice from CMS: "If the patient is admitted to inpatient status from hospital outpatient observation care subsequent to the date of initiation of observation services, the physician must bill an initial hospital visit for the services provided on that date." CMS Manual Chapter 12 Section 30.6.8.D
