If an established Medicare patient sees a midlevel for an ongoing condition (they've already seen the MD) and labs are ordered, can I bill the visit incident to under the supervising physician NPI or does it have to be billed under the midlevel because labs were ordered? I'm really confusing myself with this.
 
If the labs are part of the documented treatment plan from the physician then yes it can be billed under the physician NPI as long as the physician you are billing under is in the office suite area at the time of service. If the labs ordered are not part of the physicians treatment plan then no you cannot bill under the physician. If the physician did not document the treatment plan in a previous encounter then the visit cannot be billed under the physician NPI.
