If a patient is unable give the doctor a review of systems. (i.e. patient is intubated)
Would you code the consult. at the lowest level even though the
medical necessity his high?
 
as long as it is documented as to why the ROS is unattainable the history is considered comprehensive. So there is no need to automatically think you would be required to use the lowest level.
