Wiki Inpt Consults of exisiting pt

Scenario: oncologist provides a level 5 consult to a Medicare patient that is currently seen at his clinic. Does he get to charge a 99223 or a 99215? The CPT book says new or established patient, but I haven't been able to find any agreement or disagreement with CMS.
