Is it illegal for a patient that has active health insurance to choose to be a self pay patient & ask provider office NOT to file medical claim?
Where can I find documentation to support?
 
No - this is covered in the HIPAA Omnibus Rule effective September 2013; there are multiple caveats though - one of them being the patient must pay in full on the DOS.
