Wiki insurance vs self pay

Is it illegal for a patient that has active health insurance to choose to be a self pay patient & ask provider office NOT to file medical claim?
Where can I find documentation to support?

No - this is covered in the HIPAA Omnibus Rule effective September 2013; there are multiple caveats though - one of them being the patient must pay in full on the DOS.

In other words, it's illegal for your practice to send it to insurance, if the patient has paid in full and requested that you not send it!!!
