Should a physiican be present if lab tests are performed in the office in order to bill for those tests? What about venipunctures when a physician is out of the office?

Yes, absolutely a physician or NPP provider needs to be present in the office suite to meet incident to guidelines and bill for services rendered by ancillary staff. Otherwise, those services are not billable by any carrier.
