We have a provider who termed with our practice last month, and we processed the termination from the practice and with insurance plans as normal. We have been using a Locum provider for the termed provider since he left. We are being told that we should not have terminated the provider from insurance plans, that we should have set the termination date for 60 days in the future in order to cover the Locum. I cannot find any information to verify this one way or another, I would love to get any insight from firsthand experience if you have it!

Assuming the payer follows Medicare's rules, here is CMS 100-04, chap. 1, sec. 30.2.11 (C)

For purposes of these requirements, per diem or similar fee-for-time compensation which the group pays the substitute is considered paid by the regular physician or physical therapist. Also, a physician or physical therapist who has left the group and for whom the group has engaged a substitute as a temporary replacement may bill for the temporary physician or physical therapist for up to 60 days.

This Q&A from Palmetto translates:

Question:
If a physician leaves the practice to be employed by a different practice, would the locum still bill under the physician that has left or under his own NPI?

Answer: Group practices may bill for a temporary replacement under the exiting physician’s NPI for up to 60 days.
