We have patient's in NYS that are mentally challenged that have Medicare. The state requires them to have a physical, yet Medicare will not cover a preventive service. We don't have the patient sign an ABN. What would our options be other than not getting paid for the visit?
 
You're not required to ge an ABN, because physical exams are statutorily non-covered. You are able to bill the patient, but who is requiring the preventive exam? (it won't be Medicare). If some state agency is requiring the physical, they should pay for it...they can't expect you to do it for free. Does the patient also have Medicaid?
This came up with regards to required physical exams for the department of transportation. We expect the patient or their employer to pay for these, if their insurance does not.

I've been thinking about this some more. You say "the state" requires a physical, but which department exactly? I'm thinking this could either be something that is paid for by the state, or it could be something that has been erroneously just believed as fact when it is not.
