i was ask the question patient is in a 90 global period (had a spinal cord stimulator)but comes in for medicine refill for pain but has been on medicine for a while. Can an e/m visit be charged with a modifier 24

If the meds are for his chronic pain, then the visit would be considered global to his stimulator. If the meds were for something not pain-related (e.g. hypertension, diabetes, etc), then as long as you meet the other E&M guidelines, you can bill for an office visit with a mod-24.
 
As long as you can demonstrate through the documentation that the work done was not related to the implantation of the stimulator you should be able to charge that visit.
