Wiki Modifiers - performed by a Mid-level

When billing 99213 and 99401 which are both performed by a Mid-level provider should I use modifier SA for both?

This would depend if the service qualifys as a "incident to" service.

This pertains to patients with gastric banding who do not get an adjustment at the time, but would get additional counceling or fliers concerning their progress
