Provider is located in Pennsylvania. Is it legal/appropriate to collect money from a patient who has a motor vehicle claim? My office started collecting a down payment prior to services for when or if their auto insurance is exhausted and I was just wondering if this is legal?
 
My first question is does the patient have any medical insurance? If they have health insurance the claim would go to the health insurance as secondary with the AUTO EOB showing "benefits exhausted". If the patient does NOT have any health insurance then when their auto has exhausted they are technically self pay in my experience. I am in the state of Florida and our AUTO is a little different here but i would assume that these rules somewhat apply the same when it comes to the health insurance being secondary.
