Can the new 90791/90792 codes for psych diagnostic evaluation be used in either outpatient or inpatient settings? Also, we sometimes have an ED patient stuck for days because we can't find a mental health bed in the whole state -- how do we handle each day's reassessment? Do we use 90791 each time or use a low-level E&M (i.e. 99212) for the progress notes written on subsequent days?

Any help is appreciated.
 
I can't answer the second part of your question, but 90791/90792 are not based on inpatient or outpatient, they can be used for either.
 
In reference to your second question, the coding would depend on what was documented for the subsequent assessments. Is there "an integrated biopsychosocial assessment, including history, mental status, and recommendations" documented each day? While the patient remains in the ED, are they only being "reassessed" each day or are they receiving psychotherapy. If the daily "reassessments" do not include any of the above, I would use the appropriate E&M code.
