We had an established patient come in for the flu vaccine today, and mom also brought his sibling to the appointment. The sibling is a new patient to us, and mom asked if we could give the flu shot to this child as well. The provider agreed to have his nurse give the child a flu shot. My question is, because we are only billing for the administration of a flu vaccine by the nurse, when the child comes back in to establish care, can we bill this as a new patient office visit?
 
Unfortunately, this would be established unless it occurs in more than 3 years from now. "A new patient is one who has not received ANY PROFESSIONAL SERVICES from the physician/qualified health care professional or another physician/qualified health care professional of the exact same specialty and subspecialty who belongs to the same group practice, within the past 3 years."
