My doctor is starting his own practice under his own tax id but the same office (leaving his employer,share office space). Should the patients he has been seeing now be coded as a new patient, even though he has been treating them?
 
His current patients remain established;
Regardless of the Tax ID, a new patient will always be one that has not been seen in 3 years.

I agree. The new/vs established follows the provider's personal NPI, not just the Tax ID the previous visits were paid under.
 
Practice only comes into the equation when the specific practitioner has not provided a face to face service to the patient in 3 years.
