A patient came in to see the general surgeon on 12/06/11 and had a unilateral duplex scan of the extremities done (CPT code 93971)....no office visit was billed. The patient came back into his office on 01/03/12. Would she be considered an new patient or established patient? I'm leaning towards her being a new patient since she wasn't actually seen in office, the only thing done on 12/06/11 was the scan.
Any thoughts???

if there was no face to face time with the physician and the patient during the time of the duplex scan the patient is considered new.
 
There is a CPT assistant out there somewhere that states what a new patient consists of, I had the same problem when I worked for a radiology group that also had vascular surgeons under the same tax id, our radiologist would do the duplex scan and then the patient would come in for a consult with the surgeon for endovenous ablation or sclero or whatever.
