If a provider is not a DME credentialed provider can they still provide DME products to Medicare patients as a cash pay service? If so are they required to have the patient sign an ABN at the time of service since Medicare would pay if they were a DME provider. Also I know for most of us it is common sense that making a patient sign an ABN after the fact is not acceptable since it is an "advanced notice" but is there somewhere that states this is illegal? I have an Office Manager who does not understand this concept. Thanks

Medicare says this: https://www.medicareinteractive.org...dicare-appeals/advance-beneficiary-notice-abn

You may not be responsible for denied charges if the ABN:
  • Is difficult to read or hard to understand
  • Is given by the provider (except a lab) to every patient with no specific reason as to why a claim may be denied
  • Does not list the actual service provided, or is signed after the date the service was provided
Also, Page 7, here (click me) shows how to fill out an ABN for a non-participating supplier.
