When the insurance company requests the progress note to process a claim, does the patient need to sign an authorization form to release the records to their insurance? I'm not sure if sending them without the patient signature would be a HIPAA violation or not. Thank you for your insight.
 
The contract you have on file with that payer gives them the authority to receive records without a signed authorization from the patient.
 
Also keep in mind that HIPAA allows sharing of PHI without patient authorization for the purposes of treatment, payment or operations. This would certainly qualify as release for payment.
