We had a discontinued procedure in our ASC due to unanticipated respiratory problems after the patient was under anesthesia. Are we obligated to bill this out? I know we are ABLE to bill it, but is there any problem with us NOT billing it if we choose not to?

The physician feels bad for the patient that he has to pay a lot of money for a surgery that didn't happen and would like to waive the charges.

As long as there is no relationship (friend or family) with the physician office and a note is placed in the chart as to the reason this is not to be billed then you can put it to compassionate care. Some states limite the dollar amount that can be written off this way.
