I work at a Physical Therapy clinic in Alaska. We are seeing a patient for a worker's compensation injury that he sustained in Montana. Which reimbursement fee schedule will we be subject to for reimbursement: Alaska or Montana? Ours in Alaska is much higher.

Out of State WC

My personal experience has been that the employer's location determines jurisdiction. We border three states and DC, plus we're located near major highways and have treated contractors, truck drivers, etc. from other states. Even though the injury may have occurred in our state, the employer's state has determined jurisdiction. Even in those cases where the employee lives in our state and treats in our state, but the employer is located elsewhere, the employer state has determined jurisdiction. It can be frustrating.
