The Patient Affordable Care Act (2010) requires overpayments to be refunded within 60 days; however, some states have different time frames. For example, in Texas, patients must be refunded within 30 days (https://www.texmed.org/Template.aspx?id=33085).

In short, check your state laws. If your state law doesn't specify a required time frame, then use the 60 days as stated in the Patient Affordable Care Act (2010).
