If the patient had services rendered in the ED but wasn't seen by the physician, can we bill a facility charge? If so would it be an ED level charge?

Patient seen in the ED but not by an ED physician

The facility charge is not predicated on the physician, it is based on utilization of the facility resources. Your facility should have a "tool" that you use to determine the level of service, it is not the same as the physician guidelines for E&M. Your level needs to meet criteria on that tool.
