I work in Neurology and we do Botox and other tests. If a patient has Botox on 1/18/17 and returns to our office on 1/26/17 to review a test result that is not related to the Botox, but addresses that there is improvement with Botox for her other issue, can I use a 24 modifier? Any help would be great. Thanks!!!

I would think that if they were there for an E/M visit for something UNRELATED to the previous botox, you could still bill for that E/M with modifier 24. It's just a coincidence that the previous botox treatmenet happened to have an unanticiapted side-effect that rolled-over into the current and technically unrelated issue. Just be careful in the wording of the encounter and be CLEAR that the new encounter was for a new problem unrelated to the botox performed on 1/18.
