my boss does alot of surgery's and he always bills the pre-op visit with an E/M code, should this visit be coded as part of the surgery?

Pre-op evaluation is part of the global surgical package. He shouldn't submit a claim for reimbursement in the situation you're describing. Hope that helps! :)
 
Global ... EXCEPT

The visit is global to the surgery EXCEPT in cases where it is the decision for surgery (modifier -57).

So the patient who presents for a hernia repair that was scheduled, should not also be billed for the required H&P evaluation prior to the surgery.

While the patient who presents in the ER with RLQ pain, nausea and an ultrasound consistent with acute appendicits, will likely require a billable E/M service that is the decision for surgery.
