Technically yes. Since infusions are an 'incident to' service, they must meet all of those requirements for billing, including that the service must be supervised by the physician who is also the employer of the staff performing the service, so the claim should not represent that the service was 'incident to' a different provider.

If the prescribing doctor is also a member of the same practice, then billing under that doctor instead would not likely be a major issue since the payment is going to the same tax ID (assuming the service was appropriately supervised by another physician in that same practice). However, if the prescribing provider is not from the practice that employs the staff performing the infusions, then clearly in that case it cannot be billed under that provider. I believe most practices bill under the physician who is actually on site and this is the safest and most compliant practice.
