When billing for 94761 (pulse oximetry for oxygen saturation; multiple determinations. Do these have to be performed by the physician, or can a nursing check count as a determination?

Multiple determinations (semi fowler, high fowler, sitting positions noted) are documented by EXERCISE OXIMTERY; can only be billed if multi determinations are completed in a single occurrence; cannot convert numerous single determinations 94760 into a multiple determination 94761 because the multiple determinations in a single setting must be documented:
94761 - OXYGEN flowsheet will provide support for: Multiple pulse oximetry with several Sao2 (Spo2) determinations reported usually taken while the patient is sitting, standing, and walking. (e.g exercise)
most of the time when 94760 is performed patient is lying in bed.
