I have a physician that is billing pain pump refills 95990 (done by nurse) in the ASC. He says they need to be billed as POS 11 because the ASC has an office but he has no contract/financial agreement with the ASC. In my opinion, the pump refills should not be billed at all, one because it is done by a nurse employed by the ASC, two because he has no financial agreement with the ASC that would allow him to bill as POS 11. Medicare will not pay for them with POS 24. Please does anyone have any input/thoughts on this?
