If during a global period a patient is seen back at the hospital by the same provider but the actual Dx is different would that constitute a modifier 24 even if it seems related to the previous procedure?

If it is related to the surgery, then the modifier 24 would not be appropriate. If there was a complication you could expect to see a new diagnosis, but that by itself does not indicate that the service are or are not related to the original procedure.

post op E&M

I would suggest you ask the physician if the follow up dx is related/caused by the surgery. If no, add mod 24. If yes, then it's a post op complication covered in the surgical global package.
