If 50% of a one hour visit was spent C&C care for a consultation, that would be a 99244 correct?

Yes, as long as they document that 60 minutes was spent, >50% was spent counseling (or they could say 45 of 60 minutes) and they describe the content of the discussion, that should be fine.

MD is good at documenting more than >50% of x minutes spent...etc etc
He's just coding it as a 99245.

Yeah, that's just wrong. Doesn't get much easier than that.... the times are right there in black and white.
