Can individual therapy and group therapy be billed on the same day using modifier -59 on second service or will this be denied or require a payback down the road?

From our experience, yes they can. But your documentation must clearly show the are adressing different things. If the group and the individual therapy are both for depression, in our experience, one service was denied because it wasn't addressing separate issues.
