Does anyone know of a written policy that states that billing a secondary claim is a courtesy and not a requirement?

Meaning that it is up to the patient to bill the secondary? I've never heard that at all. It is up to the patient to get any necessary documents that we are not privy to, but we do this all the time. If medicare does not forward the claim we have to, with the primary EOB, if we want to get paid.
