Can anyone help me out with this problem. I have a doctor that spent 15 minutes talking to a patient concerning their smoking. The patient is not interested in quiting. The doctor went over the options available and gave the patient advice on quiting but per note "patient is not motivated" to quit.

Can I bill the 99407 even though the patient does not want to quit?

As I understand the code 99407 you may bill it as long as your physician has sufficiently documented the counseling. The description includes assessing readiness for change and barriers to change; I feel the patient not "wanting" to quit would fall into the later catagory, patient compliance is not a billing criteria for this code.
