I have a grp that as just realized that 99361 was deleted. They are asking if they can use 99366 when the Dr. talks with the rehab nurse after he sees the work comp pt. Most of the time the Dr. spends less than 30 minutes with the nurse. They have done this in the past and the rehab nurse has reimbursed on the spot for this service and the she gets reimbursed from the work comp carrier. I have told them no this is included in the E/M. Am I leaving money on the table?

The patient must be present for the conference with 99366 and it has to be at least 30minutes.

Also there have to be at least 3 qualified health care professionals from different specialties or disciplines to use any of the codes in this section.

So based on what you have stated I don't think your service would qualify for these codes.
