Hi there!

Are there any rules/guidelines for an LCSW billing psychotherapy for her employee?

Also are there any rules/guidelines for a time frame between a person being treated as a patient to then starting a business relationship/ employee relationship?

Please help!
 
Although this behavior is flirting with "self referral" laws, the question should be directed more to the ethical practices of creating a dual-relationship rather than trying to find out how to bill. There's a threat to the provider's license and lawsuits. What happens if the ex-employee turned patient gets angry and claims they aren't receiving the help they need because of the pre-existing relationship? Or what if an employee thinks it's unfair that the provider has hired a patient/ex-patient, as in favoritism? There' just no leg to stand on for the provider.

If the provider isn't referring the patient elsewhere due to conflict of interest, I'd question the ethical, professional, and confidential standards of that provider. The APA has a reporting system for this type of activity, so that shows the severity of the situation.
