What is the length of time we must keep our paper EOB's stored before we can shred? I think the CMS website states 3 years unless litigation ensues before the 3 three years is up, maybe I read it wrong, I can't always understand CMS jargon. We asked another office and they only keep theirs for 1 year. Still another office states since they are considered part of the patient's records you have to keep them the full 7 years from last date seen. Does anyone know?

Your best bet is to check your state's record retention laws or your practice's attorney or accountant. EOBs are considered financial information, so that may affect the time period for retention. If they are scanned into an electronic system that will also affect whether you need to keep the paper copies.
