Tobacco Cessation 99406 for the Parents

We have a vast amount of parents/guardians that expose our patients to second hand smoke. When the physician is aware, we educate the parent/guardian on tobacco cessation. May we bill for the counseling done for the parent with the patient present??

CPT Assistant includes a 2009 article that says the tobacco cessation counseling codes 99406 and 99407 cannot be reported on a claim to the child's health plan when the counseling is directed to the parent(s). If counseling is provided during a preventive service or a problem-oriented visit addressing tobacco exposure in the context of the presenting problem, the counseling is included in the E/M service. If the parents are agreeable and all requirements for reporting 99406-99407 are met, it may be possible to report to the parent's health plan. (Payer may question claim from pediatrician for adult patient.)

I wish I had a different answer for this one but hope it is helpful.
