If a resident does the entire WCC and the TP only states, "I discussed the assessment and management of the patient with Dr. Resident. I reviewed and agree with Dr. Resident's note. Followed by physician signature.

Is this considered unbillable because the TP didnt state he/she saw the patient or does it the visit fall under the primary care exception?
 
Medicare, Medicaid or Commercial

This is not acceptable attestation for the teaching physician for Medicare.
Google "primary care exception" and you'll get information telling you what the lower levels of EM that can be used under this exception.

In our practice (pediatrics) if the patient is covered by Medicare (rare) or Medicaid (more common) we adhere to the requirement that the TP was present and participated. If the patient is covered by commercial insurance, we allow the kind of statement you have indicated.
