If a hospital is using an outside company As first assist with a general surgeon, is it common or would it be a compliance issue for the hospital to provide the CPT codes and dx codes to the first assist company? The company does not employ their own coders and would like us to provide them with a copy of our claim to obtain this information for their billing company. There would be no charge from the hospital to the first assist for providing the claim information.
 
Assuming the outside company is a covered entity since they employ a provider, it is not a compliance issue to give them a copy of the claim since providers are permitted under HIPAA to share PHI for purposes of treatment, payment and operations. If for some reason this company is not technically a covered entity, then a business agreement would need to be in place in order to allow the information to be shared.
