Wiki Evacuate a Hematoma

We are assisting another office who wants to charge for an evacuation of a hematoma that was encountered immediately after the patient was opened. I would think that this would be included in the procedure. They want to unbundle the procedure by using a Modifer 59 for the evacuation and also bill for the gallbladder removal. I don't think that this meets the critieria since it is in the same anatomic area and also through the same incision. They keep saying that this is a distinct procedure. Am I correct in my thinking?
